Januar. - Vor einiger Zeit leitete Saml. L. Clemens (Mark Twain) einen Prozeß gegen die Verlagshändler Belford, Clark &amp; Comp. ein, um sie an dem Nachdruck seiner Werke zu verhindern. Es stellte sich im Laufe der Verhandlungen heraus, daß Kläger kein Verlagsrecht für die fraglichen Werke erworben hatte, allein er beanspruchte dagegen sein Schriftsteller-Pseudonym Mark Twain als Handelszeichen (Trade Mark). Das Gericht entschied, daß „Noms de Plume“ nicht als Handelszeichen betrachtet werden könnten und daß der Nachdruck der Werke in Ermangelung des Verlagrechts statthaft sei.</td></ins></div></td></tr>

L. Clemens (Mark Twain) instituted a lawsuit against the publishers Belford, Clark &amp; Comp. to prevent them from reprinting his works. During the proceedings it was established that the plaintiff had not acquired any publishing rights for the works in question, but that he was instead claiming his pseudonym “Mark Twain” as a trade mark. The court ruled that “Noms de Plume” could not be considered a trade mark and that the reprinting of the works was permissible in the absence of established publishing right.</td></ins></div></td></tr>
